QUESTION 1
One evening while driving home after work, Tsepo was a witness to a cash-in-transit heist and a shootout happening in front of
him. Tsepo pulled off the road because he did not want to be involved in the shootout, but he used his cell phone to take photos
of what was happening at the scene. It turned out that another motorist, David, who was right behind Tsepo’s vehicle, had a
camera installed on the dash of his car, which automatically records everything in the view of the camera through the windscreen
of the vehicle. This robbery incident was also captured by David’s dash camera. The robbers were later arrested and have to face
criminal charges. Discuss whether these cell phone photos and video recording can be used as evidence in a court of

from her bank account. She wants to know whether this person, when he is identified and taken into custody, can be charged
