Level of Proof Needed For Search Warrant - ANS- Probable Cause
Scope of a search w/warrant - ANS- Only items that are listed on the warrant and in
locations those items would be located, no where else
When must a search w/warrant be terminated - ANS- When the items on the warrant are
found
Items that can be temporarily seized for officer and public safety - ANS- Any type of
weapon
Contraband - ANS- Any items not legal to posses
-Must be found legally by the officer
Items that may be seized pursuant to a valid warrant - ANS- -Contraband
-Instrumentalities of a crime
-Fruits of a crime
-Evidence of a crime
-A person to be arrested or a person who is unlawfully restrained
Legal justification needed to legally search a cell phone - ANS- -Consent
-Valid Search Warrant
-Exigent Circumstances
When can a valid consent search be made and what can be searched? - ANS- Anytime a
consent search can be made.
Anywhere the person gives permission to search
Circumstances reqarding 3rd party consent searches - ANS- The 3rd party must have
permission from main person to access the location that is being searched or the item
being searched.
Example: Boyfriend gives girlfriend permission to use his computer and she finds illegal
items on his computer. She can give L.E permission to search computer
When must a consent search be terminated? - ANS- When the person tells you to stop
searching
Open View - ANS- Open to the public. Observation into a place with a right of privacy
, Example: Standing on the road next to a vehicle at a traffic stop
Plain View - ANS- You're in a place with a right to privacy already. Its not a search but a
seizure
Types of Evidence - ANS- -Testimony (Verbal Statement)
-Physical (Objects)
Demonstrative (Measurements, Drawings, Simulations, Etc)
-Direct (Something We See, Smell, Etc)
-Circumstantial (Suggests or Infers Something, But Not Exact Proof)
