Minimum wage in California - $10.50



Learner Exemption - for first 160 hours working a job learners can be paid 85% of minimum wage



Food and Lodging as part of minimum wage - Food and Lodging can be made part of minimum wage,
but there must be a written agreement between employers and emplyees and the rates listed in
section ten of IWC order must be charged



When do Agriculture workers earn overtime - after 10 hours and first 8 hours on 7th day they get 1.5 x
pay, after the 8th hour on 7th day of work they get 2x pay



Deductions made without employee consent - only required deductions can be made, need employee
consent for meals, medical insurance, etc.



When are paid breaks earned - every four hours, or major fraction thereof a 10 minute paid break is
earned



Maximum working hours to not get a rest break - 3.499 hours



Minimum meal period length, and when earned - 30 mins, earned after 5 hours of work, unless work six
hours only and agreed by employer and employee



Payday details - Must pay on the same posted day every week



Wage deduction statements include: - Employee name, Date wages received, Pay period dates, Total
hours worked, Pay rates, Hours worked at each of the pay rates, Gross Pay, Net pay, Any deductions,
FLC's name and address, grower or employing firm's name and address, number of piece rate unites if
applicable

, Wage deduction statements must be kept for - 3 years



Applications and all terminated employee files are kept for - 2 years



Payroll records should be kept for - 4 years



Copies of applications, all personnel records, minor's employee files that show their ages should be
kept for - 3 years



Records of people who provided services to your company should be kept for - 8 years in case of
employment tax audit



Pay rate posting requirements at the worksite - Regular pay day, IWC order, Minimum wage poster, A
poster with FLC name, FLC license number, all applicable pay rates in English and Spanish



Final Pay Details - If quit with no notice pay within 72 hours, if terminated pay immediately, if quit with
notice pay within 72 hours of notice, if disputed wages pay them then dispute later, if fail to pay penalty
will be their regular wages.



Shepherds working conditions - Need visitor access to fixed housing or mobile housing if applicable,
need a form of communication such as a cellphone, need weekly mail service



Minimum employee wages to force them to supply own tools - twice the minimum wage



When can you deduct for broken equipment? - when the employee intentionally breaks it



Workmans Compensation Insurance - all employees temporary or not must have it



Penalties for WCI - If don't have it: double the amount premiums would have been or $1500 per
employee whichever is greater, cannot do business until get WCI and must pay all employees regular
wages for first 10 days of non operation
