What is Legal English?
Legal English is the specialized form of English used within the legal profession. It appears in
contracts, statutes, court decisions, and legal correspondence. It employs a unique vocabulary,
formal syntax, and structures (archaic terms, Latin/French phrases, passive voice and
nominalizations) to ensure absolute precision and avoid ambiguity.

Why is Legal English important?
Ambiguity in legal documents can lead to costly disputes or wrongful outcomes. In Tamplin’s

Wharf Ltd v. Anglo Mexican Petroleum Products Co. (1916), vague contract wording produced a
lengthy litigation. Further, English often serves as the global lingua franca in treaties and
international arbitration, making mastery of Legal English indispensable worldwide.

Key Characteristics:

Precision in Vocabulary: “Shall” versus “may” carries enforceable duties vs. permission.
Passive Voice: Focuses on actions (“The contract was signed...”).
Nominalization: “Termination of the agreement” rather than “the company will
terminate.”
Complex Sentences: Multiple clauses to cover contingencies.
Latin/French Terms: E.g., hereinafter, whereof, habeas corpus.

Historical Timeline

Old English Era (Before 1066)

Law was oral and customary, conducted in Old English dialects, with minimal written records.

Norman Conquest & French Influence (1066–1350)

Anglo Norman French became the language of courts and administration. Terms like plaintiff
(plaintif) and defendant (defendre) entered English law.

Latin’s Dominance (12th–17th Centuries)

Latin was the scholarly and legal lingua franca. Maxims such as actus reus (“guilty act”) and mens
rea (“guilty mind”) were codified in Latin in court records and treatises.

Shift to English (18th Century Onwards)

Statutes and legal commentary transitioned to English, though many French and Latin terms
remained. The Plain English movement of the 20th century sought to simplify drafting while
preserving precision.
