ILW1501 Introduction to Law
Law - answer a set of rules / norms that governs the human behavior, should be obeyed
by all of society and is binding, is enforced by state / state organs and when you do
something wrong you may be prosecuted and punished or be ordered to compensate
the injured party.
Private Law (Civil Law) - answer deals with a relationship between two individuals.

public law - answer deals with a relationship between the state and an individual. state -

2 main methods used to divide South African Law - answer1. 2 main divisions -> Public
Law and Private law
2. 2 main divisions -> Formal (procedural) law and Substantive (material) Law
Formal Law (procedural law) - answerProcedures that must be followed in legal
proceedings.
Substantive Law (material law) - answerDetermines the content and meaning of
different legal rules.
How Formal Justice Achieved - answercertain basic requirments must be met, when
these requirements are met, always applied, in exactly the same way then formal justice
has been achieved.

- explicit rules on how people must be treated in specific cases
- rules applied generally to all people in the same circumstances.
- rules must be applied impartially. the judgr may not apply rules unequally and must not
be bias.
