,INTRODUCTION TO THE CONCEPT OF
DISCRIMINATION
Discrimination refers to any unjustified distinction or unequal treatment of individuals
based on certain characteristics, such as:
race,
ethnicity,
gender,
religion,
disability, or
other protected attributes.
,TYPES OF DISCRIMINATION
The Law No. 10221/2010 “On Protection from Discrimination” in Albania provides a
comprehensive framework to combat various forms of discrimination.
1. Direct Discrimination
Definition: Occurs when a person or group is treated less favorably than another in a
similar situation based on protected characteristics.
Article 3(2) of Law No. 10221/2010
Example: Refusing to employ a qualified individual solely because of their ethnicity.
, TYPES OF DISCRIMINATION
2. Indirect Discrimination
Definition: Arises when a neutral provision, criterion, or practice disproportionately
disadvantages individuals based on protected characteristics, unless objectively justified by a
legitimate aim.

Example: Implementing a company policy that requires all employees to work on specific
religious holidays, which may disadvantage individuals of certain faiths.
