Commercial Law Exam.
14th December 1pm-3pm.
There are 3 sections: Contract, Agency and Delict. 2 Questions
are asked but you only pick one question from the two/ from
each section.
Look at specific areas of guidance, initial read through the
materials and look at tutorial questions and marry them
together. There are never absolute answers, they are
suggested ways of approaching it.
Have in the back of your head in any law question: question 1.
“What is she asking me here?” “Which area of law is she asking
me here?”. Applied law.
Same format as tutorial questions.
You are not going to be asked explicitly about the Scottish court
structure but if you have time at the end and are tidying up what
you have said you might want to say something like “well
sometimes these things are decided in terms of alternative
dispute resolution” or “you would go off to the civil court
structure- court of session or sheriff court”. That will get you
extra marks because you are giving a solution at the end and
describe it in ordinary everyday language. Buzzwords- pick up
marks.

Part 2- Describe it in everyday English

cases and try to give names. Refer to case notes.
