Explain the financing of advice and representation for Kelly

Kelly has been charged with assault, which is a triable either way offense and therefore
her case will be heard in the Magistrates’ Court. At the police station, Kelly has the right
to free legal advice, which will be provided by a defense solicitor, also known as a duty
solicitor. To qualify for legal funding for representation in the Magistrates’ Court, Kelly
will have to pass the means test. This assesses her income. She will pass this test if her
