Conven/on of Chicago 1944
• Signed by 52states. It conducted to the crea/on of the ICAO which has its
headquarters in Montreal, Quebec
• « The Contrac/ng States recognize that every State has complete and exclusive
sovereignty over the airspace above its territory »
1. Horizontally ➔ Extending to 12NM from the land
2. Ver/cally ➔ The atmospheric space above the horizontal limit
ICAO
• Objec/ve ➔ Develop in a safe & orderly manner the ICA & to assure that the
interna/onal air transport services may be established on the basis of equality of
opportunity & operated soundly & economically
• It is composed of:
1. The Secretariat ➔ Divided to 5 main divisions
2. The Assembly ➔ meets every 3years to appoint the Council & direct them
on their next 3years work. An extraordinary mee/ng may be held upon the
call of the Council or at the request of not less than 1/5 of the total number
of the contrac/ng States
3. The Council ➔ Governing body, composed of 36 Contrac/ng States. It tasks
the “Air Naviga/on Commission” (19 members) with dra^ing SARP
Hierarchy of ICAO publica/ons
,Standards And Recommended Prac/ces (SARP)
• Standard Prac/ces ➔ All rules deemed necessary by the ICAO in order to ensure the
safety or regularity of interna/onal air naviga/on. ICAO expects contrac/ng states
to adopt them.
1. Whenever an amendment is required to a SARP then no/fica/on shall be
made to ICAO within 60days
2. Whereby compliance with any exis/ng SARP is imprac/cal, immediate
no/ce shall be given to ICAO
• Recommended Prac/ces ➔ Regarded as desirable to ensure safety. They are
procedures which member states are recommended to adopt. A state may opt out
of any of them
• If a member state chooses to adopt a SARP, they must tell ICAO & list details in their
AIP

Agreement of Paris ➔ Piece of EU legisla/on which allows what would
otherwise be “cabotage”
Freedoms of the air
• First – Overflight ➔ fly across a State’s territory without landing
• Second – Technical Stop ➔ land in a State’s territory for non-traffic (refueling,
maintenance)
• Third – Carry traffic to any country ➔ put down in the territory of the first State,
traffic coming from the home State of the carrier
• Fourth – Bring traffic from any country to homeland ➔ take on in the territory of
the first State, traffic coming from the home State of the carrier
• Fi^h – A/C from A carrying from B to C ➔ put down & take on, in the territory of
the first State, traffic coming from or des/ned to a third State
• Sixth – Combina/on of 3 & 4 ➔ transpor/ng, via the home State of the carrier,
traffic moving between 2 other states
• Seventh ➔ transpor/ng traffic between the territory of the gran/ng state & any
third state with no requirement to include on such opera/on any stop in the
territory of the carrier state
, • Eight – Consecu/ve cabotage ➔ transpor/ng cabotage traffic between 2points in
the territory of the gran/ng State on a service which originates or terminates in the
country of the foreign carrier
• Ninth – “Stand alone” cabotage ➔ transpor/ng cabotage traffic of the gran/ng
State on a service performed en/rely within the territory of the gran/ng State
Different Conven/ons
• Warsaw (1929) ➔ deals with the liability & compensa/on of the air carrier upon the
damages caused to baggage & passengers on board an A/C or during any of the
embarking or disembarking opera/ons. It may extend to the carriage of only
interna/onal mail & cargo
• Rome (1933-1952) ➔ states the operators & pilots liabili/es towards persons &
goods on the ground, in case of damage & injury caused by the opera/on of an A/C
registered in a Contrac/ng State in the territory of another Contrac/ng State. The
right to damages is lost if an ac/on is not brought within 2years
• Tokyo (1963) ➔ A/C in the event of offences & criminal acts commioed on board.
Flying outside the territory of any State ➔ laws established by the State of Registry.
Any Contrac/ng State may denounce the Conven/on by no/fica/on addressed to
ICAO. Effect 6months a^er the receipt by ICAO
• Hague (1970) ➔ to prevent hijacking
• Montreal (1971) ➔ deals with the unlawful acts of violence on board or at airports
& destruc/on of A/C in flight or naviga/on facili/es. Any Contrac/ng State may
denounce this conven/on which shall take effect in 6months
• Montreal (1999) ➔ Compensa/on to vic/ms of air disasters & operator’s liability
regarding mail, cargo & baggage. (Amended to Warsaw 1929)

• Interna/onal Air Transport Associa/on (IATA) ➔ It is a world-wide trade associa/on
for the world’s airliners, represen/ng some 260 airlines or 83% of the total air
traffic.
Their mission statement is to “represent, lead & serve the airline industry”
Its main priori/es are Safety, Security, Simplifying business & more recently, the
Environment
