Que 2: What do you understand by term "ethics" of legal profession. Explain
Ethics of Legal Profession
1. Meaning and Concept
In simple language, Legal Ethics is the "Code of Conduct" that tells a lawyer how to
behave. It is not just about being a "good person"; it is a set of mandatory rules that
ensure the legal system remains fair and trustworthy.
The legal profession is considered a noble profession, and to maintain its nobility,
every advocate must follow certain professional norms and etiquette. These are
primarily governed by the Advocates Act, 1961 and the Bar Council of India (BCI)
Rules.

2. The Four Pillars of Legal Ethics
A lawyer has ethical duties toward four different groups. You can remember them with
this table:
Duty Key Ethical Rule
Toward
The Court To act as an "Officer of the Court," showing respect and never misleading
the Judge.
The Client To maintain "Attorney-Client Privilege" (confidentiality) and be loyal to
their interests.
The To be fair and polite; never to negotiate directly with the opposite party
Opponent without their lawyer.
The To not "Solicit" (beg/advertise) for work and to maintain the dignity of the
Profession black robe.
3. Key Principles (With Examples)
• Confidentiality (Section 126, Evidence Act): A lawyer must keep the client’s
secrets.
o Example: If a client confesses a past crime to his lawyer, the lawyer
cannot go to the police and tell them.
• Conflict of Interest: A lawyer should not represent two people who are fighting
against each other in the same case.
o Example: You cannot represent both the Husband and the Wife in a
divorce case.
• Candor (Honesty) to the Court: A lawyer must never present false evidence or
lie to the Judge.
• No Solicitation: Unlike a shopkeeper, a lawyer cannot put up a big "50%
discount on bail" poster or distribute flyers to get clients. The profession is a
service, not a trade.
4. Why are Ethics Important? (The "Why" Factor)
1. Public Trust: If lawyers are seen as liars or cheats, people will lose faith in the
Judiciary.
2. Fair Trial: Ethics ensure that the battle in court is fought with "clean hands."
