1.1 HOW CAN THE PRINCIPLES OF UBUNTU BE APPLIED IN THE
CRIMINAL JUSTICE SYSTEM TO ENSURE JUSTICE FOR VICTIMS?
I cannot truly define Ubuntu nor it is not easily accessible to get a well-defined definition of
UBUNTU. In my own understanding Ubuntu is a mirror of people South Africans in all walks of life.
It is a common cause that people of South Africa are peaceful, respectful, with inner goodness,
personhood, and togetherness.
Constitution has infused the ethos of Ubuntu principles to criminal justice system to protect all
victims fairly and accused. All law passed in parliament encourages criminal justice system to
promote values of Ubuntu. When they are dealing with matters involving victims of rape. In SAPS
have trauma rooms for counselling. Police officers are trained to take correct information from all
victims, do whatever necessary to assure to the victim’s state cares. South Africa has a dark history
of human rights violations.
Ubuntu fits nicely to infuse “Motho ke Motho ba Batsho". Criminals’ strips human beings’
personhood, happiness, and dignity. Criminal justice system is entrusted with a heavy responsibility
to hear and solve all matters that are forwarded to criminal justice system. In shocking way, the
criminal justice system is tasked to treat victims and perpetrators with fairness and equality.
