Introduction
Heavy flooding in Giyani has created a severe humanitarian and governance crisis.
Homes have been destroyed, infrastructure has been damaged, children are unable
to attend school and communities cannot access water, roads and other basic
services. In such circumstances the Constitution places a strong responsibility on

municipalities on how to respond to situations that disrupt service delivery. These
laws explain how services must be provided, how communities must be assisted and
how cooperation between government and residents should take place. In the case
of the floods in Giyani the local municipal council and residents must understand
their responsibilities to restore services, protect communities and rebuild the affected
area.
Giyani Local Municipal Council service delivery responsibilities
The Constitution places the first responsibility for service delivery on municipalities.
Section 152 identifies the main objectives of local government, which include
ensuring that services are provided to communities in a sustainable manner.1 This
means that municipalities must provide essential services such as water, sanitation,
roads, waste removal and infrastructure even during times of crisis. When floods
destroy infrastructure and disrupt daily life the municipality must take immediate
steps to restore these services so that residents can continue their lives safely.2 The
