Workshop 5
Preparatory Task 1
Property 1 – Granby Terrace
Pursuant to General Vesting Declaration 143 the ownership of Granby Terrace is due
to transfer to the Authority (Secretary of State for Transport) on 07 May 2019.
This property is within the safeguarded area. As a result, the property owner may
claim compensation via the following two schemes:
Express Purchase Scheme
Need to Sell Scheme
Client does not qualify as the rateable value is over £44,000.
Option 1 is to wait for a CPO to be issued. Option 2, is to negotiate with the HS2
project, which is being decided on a case by case basis.
Property 2 – Kenilworth
Whilst GVD 120 relates to Kenilworth, this particular property does not appear to be
required for HS2. However, the property may still be affected by the development as
it will be within the close proximity.
The HS2 line does not run through the property, but will be in the proximity. Thus, the
property is likely to be in the rural support zone. As a result, the property owner may
claim compensation via the following two schemes:
Cash Offer or Voluntary Purchase Scheme
Need to Sell Scheme
Our client does qualify for these schemes as the rateable value is below £36,000.
CON29
Question 3.5 refers to nearby railway schemes
Question 3.12 refers to any CPOs
Lastly, a question should be raised to the seller’s solicitor for any
notice/correspondence relating to either of the above.

Search Tutor comment
Index map search Carry out this search (para 17.15.2
Local search This search is always carried out
Commercial drainage Yes
Coal authority Yes, due to the mining right.
Land charge act No as the land is registered
Land registry search Yes, this will be dealt with in workshop 9
Companies register check This is not required as the seller is not a
corporate entity. Dave Jenkins is the
seller. Instead, a bankruptcy search
should be carried out.
Highways authority Yes, due to the dotted line on the title
plan. This line may be a verge (i.e. strip
of land/grass). This needs to be
determined as someone may own this
land separately.
Chancel repairs This is becoming a bit of an “always do”
search”, regardless of the proximity of
church..
Environmental search Yes, carry out a desktop study to
determine any risk.
Flood Flood search is also an “always do”.
CON290O
Pipelines and Common Land/TVG are becoming always do.
Advertisements (5) would also have been an appropriate search due to the wish of
the client to let out the property to tenants.
It may also appropriate to conduct a mineral consultation (16) due to the mining
reservation. However, this may be over the top given the property is in the centre of
Bristol. Tutor would not have marked down
Environmental is not selected (18) as a desktop is going to be conducted initially.
