Question 1
Identify one person in the above set of facts that can be described as a "lawful
holder". In your answer, specifically refer to the relevant thing(s) of which he/she
is a lawful holder.
Sipho is a lawful holder of the small room he rented from Thandi. A lawful holder
exercises physical control with the intention to derive a benefit (animus ex re
commodum acquirendi) based on a legal relationship, such as a lease agreement
(Scott, Property Law Study Guide 157). Sipho's control and intention to use the room for
his benefit, rooted in the contract with Thandi, establishes his lawful holdership, as
illustrated in Scholtz v Faifer 1910 TS 243
(Scott, Property Law Study Guide 157).
