, Fact (Factum Probans) : A Fact is anything that can be perceived by the five
senses or any mental condition a person is aware of.
Physical Fact: "A saw B hitting C with a stick" (perceived by sight).
Psychological Fact: "A had the intention to kill B" (mental state).
Fact in Issue (Factum Probandum) : These are the main points of dispute in
a case. One party claims them, and the other denies them. Proving these directly
determines the rights or liabilities of the parties.
Example: In a murder trial, the "Facts in Issue" are: Did A kill B? Did A have the
intention to kill B?.
