, 1. The functions or purpose of the Legal Practice Act 28 of 2014 as provided by
section 3 are as follows:
“To provide a legislative framework for the transformation and restructuring of the legal
profession that embraces the values underpinning the Constitution and ensures that the
rule of law is upheld.;
And broaden the access to justice in the following ways.
i. Put a mechanism in place to determine fee chargeable by legal practitioners
for legal services,
ii. Provide measures for rendering community service by candidate legal
practitioners and practicing legal practitioners,
iii. Provides measure to ensure for all aspirant legal practitioners in order to have
to have the legal profession to broadly reflects the population of south
Africans.1
And also,
i. To regulate the professional conduct of the legal practitioners,
ii. And the accountability of the legal profession to the public.”

2. Legal Practice Council Act 28 of 2014, which repeal the attorneys Act 53 of
1979 and the admission of Advocate Act 79 of 1974.
3. Whether a legal practitioner may charge 25% of the capital award as fees.
And, whether 14% VAT may be added to the 25% capital amount.

And if the contingency fee agreement between the attorney and the client was in
line with what the Contingency Fee Agreement Act 66 of 1997 provides.
