bathing suit or inner thigh
Must be reasonably construed as being done for:
Sexual purpose
Sexual arousal or gratification
Or in a sexual manner for revenge out of anger or to humiliate
1st and 2nd aggravating factors - answer Under the age of 13
During the commission of a felony
Use of a weapon or made the victim believe weapon was used
Aided by one or more actors and force or coercion was used
(Normally 3rd degree however items below make it a 1st degree)
Victim is mentally incapacitated, mentally incapable or physically helpless and one of
the following:
Actor was aided by another person
Parties related by blood or affinity to fourth degree
Coerced victim through position of authority
Or victim suffers personal injury.
If between the age of 13 and 15 one of the following must be present
Resides in the same household
Related in blood
School teacher
Employee or contract worker, volunteer, local government state, etc. and uses position
