international treaties involves multiple constitutional organs, with the President occupying a
position of formal significance. This paper examines the role of the Indian President in the
treaty-making process, analyzing constitutional provisions, historical precedents, and
contemporary practices.
The President of India, as the head of state, represents the Republic in its external affairs.
However, unlike many presidential systems, the Indian constitutional arrangement places the
President in a largely ceremonial role, with real executive authority vested in the Council of
Ministers headed by the Prime Minister. This unique constitutional design creates an interesting
dynamic in the realm of treaty-making, where formal powers and substantive decision-making
are distributed across different constitutional bodies.

CONSTITUTIONAL FRAMEWORK
Article 53: Executive Power of the Union
The Constitution of India, under Article 53, vests the executive power of the Union in the
President. This provision states that "the executive power of the Union shall be vested in the
President and shall be exercised by him either directly or through officers subordinate to him in
accordance with this Constitution." This broad grant of executive authority theoretically
encompasses the power to conduct foreign affairs, including the negotiation and conclusion of
treaties.
